Depends on the judge and whatnot.

It's really just a matter of whether it's changed enough from Yahoo's layout.

You're right, it's blatant infringement. They've taken the exact layout, minus broken images, from an earlier version. I didn't hunt down the exact one, but it's in 2003 on archive.org I think.
