Im thinking of making a site where the users are able to post pictures on my site, but will there be legal issues comming up for some pictures may be copyrighted, if so how can I get around that? Can I put something in the privacy policy?

i think you would put in the 'terms of use'

so have like a link on the bottom of the page called "Terms of Use" and place that we are not responsible for the pictures on the site?

Yeah, you'll need a disclaimer.
And probably should have a contact form available for people to complain about infringements.

I'm no lawyer, but this is how I think it works: Because users upload pictures themselves you are a "isp." If someone contacts you or sends you a DMCA request to remove the images you must comply immediately.

I have to agree with Cutter. For example if you are using a newsportal you can display pictures from newsgroups. However, copyrighted material has to be removed if you are contacted by the rightful owner of these pictures but only if he proves that those pictures are his property.

He doesn't have to prove a thing. All he has to do is send a properly formatted complaint.

Proving or not proving is for a court room.
